The Order Reverses.

Name Change for NRI from Uttar Pradesh

You live abroad, your family is in Uttar Pradesh, and you need a name change that works in both places. One fact reshapes everything here. For somebody living in India, a passport is one document among many. For you it is the identity itself: your visa, your residence permit, your bank and your employer are all keyed to it. So the sequence that works at home reverses, and the thing to think about first is what happens to the visa sitting inside your current passport.

Quick answer: Before anything else, find out what your country of residence requires when a passport name changes, because your visa or residence permit sits in the current passport. On the Indian side, publish the Central Gazette, which family in Uttar Pradesh can largely handle for you, then reissue the passport, then update Aadhaar, PAN and bank records. Where you have executed a deed abroad, it will usually need apostille or embassy attestation before an Indian office will read it.

We are a documentation office, not immigration advisers. The Indian half of this we do every month. The half that touches your visa needs the authority in your country of residence, and this page is careful to say which is which.

Why the Passport Is Different for You

For somebody living in Lucknow: Aadhaar used daily PAN used for money passport used occasionally, for travel For somebody living abroad: passport the visa is in it the residence permit is in it or tied to it the bank opened on it the employer verified it the driving licence rests on it the tenancy referenced it Aadhaar used on visits home So the advice everywhere else on this subject, which is "fix Aadhaar first", is correct for residents and incomplete for you. Your first question is not which Indian document to start with. It is what your country of residence does when the name on a passport changes.

That is not a warning meant to alarm anybody. Millions of people change their name while living abroad and it works out. It simply has to be planned in a different order.

The Visa in the Old Passport

The order we suggest to clients abroad: 1 ASK your visa or immigration authority what happens when a passport name changes 2 plan the Indian gazette around THAT answer, not the other way round 3 publish, and reissue the passport 4 then transfer or re-endorse the permit exactly as they instructed 5 then Aadhaar, PAN, bank and the rest on your next visit or remotely Step one costs an email. Skipping it costs considerably more.

Two Systems, No Automatic Bridge

What people assumeWhat is actually true
A deed poll abroad changes my Indian nameIt does not, by itself
An Indian gazette changes my foreign recordsIt does not, by itself
One of them must be enoughOften you need both
The second is a formalityIt is a separate process
They will recognise each otherOnly once legalised
Think of it as two ledgers. THE INDIAN LEDGER passport, Aadhaar, PAN, bank, property, family records THE OTHER LEDGER visa, local ID, employer, local bank, local licence A change entered in one does not appear in the other. Each has to be told. Which means the work is roughly doubled, and the sequence matters because the passport is the one document that sits in BOTH ledgers. That is precisely why it goes early in your planning and late in a resident's.

Apostille or Attestation

  1. Work out which route your country uses

India is party to the Hague Apostille Convention, so documents from other member countries are usually apostilled.

  2. For non-member countries, embassy attestation applies

Through the Indian Embassy or High Commission where you live.

  3. Legalise the document itself, not a photocopy

Requirements are specific and a copy is commonly refused.

  4. Allow real time for it

This step is often slower than everything around it, and it cannot be rushed at the end.

  5. Send scans to India before the originals travel

So anything wrong is caught while the paper is still with you.

  6. Then couriers, and keep tracking on everything

Because an unlegalised or lost document restarts this whole stage.

An Indian counter reading a foreign deed is checking that some authority has vouched for it. Legalisation is that vouching, and without it the document is simply a piece of paper from another country.

What Family in UP Can Do

Good news, and the part most people do not expect. Most of the Indian gazette file does not need you standing anywhere: the affidavit you can execute abroad and legalise, or execute on a visit home the Public Notice, two copies typed and witnessed in India the newspapers placed in your UP district, in the ordinary way the CD and covering letter prepared in India BharatKosh payment made from anywhere online dispatch to Delhi couriered from Lucknow downloading the notification done from anywhere, online What genuinely needs you in person is the PASSPORT, and that is at a mission abroad rather than in India.

Families routinely handle this end while the applicant stays abroad, and we work that way with clients most months. What we send back is scans at every stage so nothing is filed that you have not read.

OCI and the Documents Behind It

That last one is common. Our Khatauni page covers family land records, which are frequently a generation behind and indexed by plot rather than by person.

Central Gazette: the Complete Process and File Format

Our core service: this is the Indian half, prepared from our Lucknow chamber while you stay where you are.

Stage 1: The affidavit

AFFIDAVIT (on non-judicial stamp paper, notarised in India; or executed abroad and legalised) I, ____________________ S/O ____________________ , presently residing at __________________________________ , and permanently resident of ____________________________ ______________________________________ , Uttar Pradesh, do hereby solemnly affirm and declare as under:- 1- That my name is recorded as ____________________ in my High School marksheet, Roll No. ____________________ , and in Indian Passport No. ____________________ . 2- That I have changed my name from ____________________ to ____________________ and I shall hereafter be known as ____________________ for all purposes. 3- That both the said names are the name of one and the same person, that is, myself. 4- That it is my true and correct statement. DEPONENT VERIFICATION:- Verified on this __-__-20__ that the contents of the above Affidavit are true and correct to the best of my knowledge and belief. DEPONENT

Both addresses belong in the opening line. Your current one abroad explains where you are; the permanent Uttar Pradesh one is what ties the file to this state, and leaving it out is a common cause of questions.

Stage 2: The Public Notice, in two copies

PUBLIC NOTICE (TWO identical typed copies, each signed and witnessed) It is for general information that I, ____________________ S/O ____________________ , R/o ______________________________ ____________________________________ , declare that I have changed my name from ____________________ to ____________________ and I shall hereafter be known as ____________________ for all purposes. It is certified that I have complied with other legal requirements in this connection. ____________________ Signature of Applicant WITNESS NO. 1 Signature :- ____________________ Full Name :- ____________________ Address :- ____________________ WITNESS NO. 2 Signature :- ____________________ Full Name :- ____________________ Address :- ____________________

Each witness gives signature, full name and address. Use the permanent Uttar Pradesh address here, and family members in India can serve as witnesses.

Stage 3: The CD and CD-Certificate

CD-CERTIFICATE I, ____________________ S/O ____________________ , R/o ____________________________________________________ , do hereby declare:- 1- That the matter in CD and hard copy is the same and I am responsible for any mismatch. 2- That I am responsible for the quality of CD. 3- That the CD is in MS-Word Format. 4- That the above statement is true and correct. Signature of Applicant ____________________ R/o ____________________

Stage 4: Newspapers, fee, covering letter and dispatch

  1. Publish in two newspapers of your UP district

A Hindi daily and an English paper, complete original pages, and buy six copies.

  2. Pay Rs 1,100 on BharatKosh

Which can be paid online from anywhere in the world.

  3. Write the covering letter

To The Controller, Publication Department, Civil Line, Delhi 110054, with a mobile number that works in India and an email you read daily.

  4. Assemble, check and scan everything

Scans to you before dispatch, so nothing is filed you have not seen.

  5. Courier it to Delhi, tracked

One to two days from Lucknow.

  6. Then the passport at your mission abroad

Once the notification is published and downloadable.

Send That One Email First

If you take one thing from this page: Before you start anything in India, write to your visa or immigration authority and ask: "What is required when the name on my passport changes? Does my current permit transfer to a new passport, and if so how?" Their answer decides: whether to do this now or after a renewal whether to travel before or after how long to keep the old booklet whether anything else needs re-issuing It is one email. It arrives with an answer specific to your situation, which no webpage can give you. Then come to the Indian side, and we can start the same week.

People sometimes read that as us being cautious. It is simply the one part of this we are not the right people to answer, and saying so is more useful than guessing.

Why We Say What We Do Not Know

Clients abroad often want one office to answer everything, and we would rather be clear about the line. The Indian gazette, the affidavit, the newspapers and the dispatch to Delhi are work we do every month and can do without you leaving your city. What your residence permit requires when a passport is reissued is a question for the authority that issued it, and any confident answer from us would be a guess dressed up as expertise. Vipin Chauhan, B.Tech LL.B, would rather hand you a short accurate answer and a clear question to ask elsewhere.

Name Change for NRIs: FAQs

What should I do first?

Ask your visa or immigration authority what happens when a passport name changes, because your permit sits in the current booklet. That answer shapes the timing of everything else.

Why not start with Aadhaar like everyone else?

Because that is resident advice. Abroad, the passport is the identity your visa, bank, employer and licence all rest on.

Does my visa move to the new passport?

Not by itself. Countries differ: some transfer it, some re-endorse, some want a fresh application, and some expect you to carry both booklets.

Does a deed poll abroad change my Indian name?

Not by itself. The two systems do not recognise each other automatically, so you commonly need both.

What is apostille?

India is party to the Hague Apostille Convention, so documents from other member countries are usually apostilled. Elsewhere, embassy or high commission attestation applies.

Do I have to fly home for the gazette?

No. The affidavit, Public Notice, newspapers, CD, payment and dispatch can all be handled in Uttar Pradesh while you stay where you are.

Who signs as witness on the Public Notice?

Family members in India are perfectly acceptable, using the permanent Uttar Pradesh address.

Which address goes on the affidavit?

Both. Your current one abroad, and the permanent Uttar Pradesh one that ties the file to this state.

How do I pay the gazette fee from abroad?

BharatKosh is online and can be paid from anywhere.

What about my OCI card?

It carries the name as issued, so it will no longer match. Reissue generally follows the passport rather than leading it.

Should I keep the old passport?

Yes, permanently. It is the physical link between two names for anybody checking years later.

Is there family property in UP to think about?

Often, and usually in an older spelling. Land records are frequently a generation behind and indexed by plot rather than by person.

Facts here are checked against these sources and our own casework with clients abroad. Visa and residence permit consequences are set by the country you live in, not by any Indian authority or by us, so confirm those directly with them.

The Short Version

One fact reshapes this whole subject for anybody living abroad. For a resident, a passport is one document among many and Aadhaar comes first. For you, the passport is the identity itself: the visa is in it, the residence permit is tied to it, the bank opened on it and the employer verified it. So the usual order reverses, and the first question is not which Indian document to start with but what your country of residence does when a passport name changes, because a reissued passport is a new booklet and the visa does not move into it by itself. That is one email, and it decides the timing of everything else. The second thing to understand is that you are dealing with two ledgers that do not talk to each other: a deed abroad does not change your Indian records and an Indian gazette does not change your foreign ones, so each has to be told separately, and anything signed abroad needs apostille or attestation before an Indian office will read it. The good news is that almost the entire Indian side can be handled by family in Uttar Pradesh while you stay exactly where you are.
